TERMS & CONDITIONS

These Terms & Conditions apply to bookings made with The Tenerife Boat Party through our website, by telephone, WhatsApp, email or another authorised booking channel.

By making a booking, you confirm that you have read, understood and agreed to these Terms & Conditions.

1. Who We Are

In these Terms, “we”, “us” and “our” refer to the operator of The Tenerife Boat Party. “Customer”, “you” and “your” refer to the person making the booking and, where appropriate, members of their group.

2. Age Requirement

The Tenerife Boat Party is an 18+ event.

All guests must be aged 18 or over on the date of the event.

Valid photographic identification may be required at check-in or boarding.

Guests who cannot provide acceptable proof of age when requested may be refused entry without entitlement to a refund.

3. Making a Booking

A booking is not confirmed until:

  • the required payment or deposit has been successfully received; and
  • a booking confirmation has been issued.

You are responsible for checking the details of your booking carefully, including:

  • event date;
  • ticket type;
  • number of guests;
  • customer contact details; and
  • any additional services or upgrades selected.

If any information is incorrect, you should contact us as soon as possible.

4. Deposits and Balances

Where a booking is offered with a deposit, the deposit secures your place on the selected event.

Any remaining balance must be paid in accordance with the payment instructions and deadline shown during booking or in your booking confirmation.

Failure to pay the balance when required may result in the booking being cancelled.

Unless otherwise stated, deposits form part of the total ticket price and are not an additional charge.

5. Ticket Types and Inclusions

Different ticket types may include different benefits.

The inclusions applicable to your booking are those shown for the ticket type selected at the time of purchase.

These may include, depending on the ticket:

  • live DJs;
  • pre-party access;
  • selected drinks;
  • spirits and mixers;
  • premium drinks;
  • swim stop;
  • nightclub entry;
  • beach club discounts;
  • cocktails;
  • discount cards; or
  • other promotional benefits.

Benefits associated with third-party venues, bars, clubs or businesses may be subject to their own opening hours, admission policies, dress codes, capacity restrictions and terms.

We cannot guarantee entry to a third-party venue where a guest does not comply with that venue's requirements.

6. Meeting Point and Check-In

Guests must arrive at the meeting point at the time stated in their booking confirmation.

The current meeting/check-in location is Rejoyce Bar, Puerto Colón, Costa Adeje, followed by boarding at the relevant harbour location.

Exact instructions provided in your booking confirmation take priority over general information displayed elsewhere on the website.

You are responsible for allowing sufficient travel time to reach the meeting point.

Late arrivals may miss the pre-party, boarding or departure.

The boat cannot normally delay departure for late guests.

If you miss the event because you arrive late, no refund will normally be provided.

7. Event Schedule

Advertised times, itineraries and durations are indicative and may change for operational, safety, weather or maritime reasons.

The experience may include:

  • check-in;
  • pre-party;
  • boarding;
  • boat party;
  • live DJ entertainment;
  • drinks service;
  • swim stop; and
  • return to harbour.

We may change the order, timing or duration of individual parts of the event where reasonably necessary.

8. Weather and Sea Conditions

The Tenerife Boat Party operates at sea and is therefore affected by weather, sea conditions and maritime safety requirements.

The captain, crew or operator may:

  • alter the sailing route;
  • delay departure;
  • change the itinerary;
  • cancel or shorten a swim stop;
  • return to harbour early; or
  • cancel or reschedule the event

where reasonably necessary for safety or operational reasons.

A swim stop is not guaranteed where conditions make swimming unsuitable or unsafe.

Safety decisions made by the captain or crew are final.

9. Cancellation by Us

If we cancel the event and cannot provide the booked service, customers will be offered an appropriate remedy in accordance with applicable law.

Depending on the circumstances, this may include:

  • transfer to another available date;
  • credit toward a future event; or
  • refund of the amount paid for the cancelled service.

We will communicate available options to affected customers as soon as reasonably possible.

Where the event proceeds but individual elements are altered for safety or operational reasons, this does not necessarily mean that the entire event has been cancelled.

10. Cancellation by You

All deposits paid to secure a booking are non-refundable, except where a refund is required by applicable law or where we cancel the event and the circumstances entitle you to a refund.

If you are unable to attend your booked date, you may request to transfer your booking to another available sailing date provided that your request is received at least 48 hours before the scheduled departure time.

Date transfers are:

  • subject to availability;
  • limited to alternative dates offered by The Tenerife Boat Party;
  • subject to payment of any difference in ticket price where the replacement date or ticket type costs more; and
  • not available where the request is made less than 48 hours before the scheduled departure.

If the replacement booking costs less than the original booking, no refund of the difference will be due unless otherwise agreed.

Requests received within 48 hours of departure, cancellations within that period, and failure to attend the booked event will not normally qualify for a refund or date transfer.

For leisure services booked for a specific date, Spanish consumer legislation provides an exception to the general statutory 14-day withdrawal right for distance contracts.

Nothing in this section limits any consumer rights that cannot legally be excluded.

11. Changes to Bookings

Requests to change the event date, ticket type, guest numbers, guest details or other booking information should be made as soon as possible.

A request to change the sailing date must be received no later than 48 hours before the scheduled departure time.

Any requested change is subject to availability and is not confirmed until we have accepted the change and issued confirmation.

Where a change results in a higher booking price, the additional amount must be paid before the change is confirmed.

Changes requested less than 48 hours before departure may be refused.

12. Group Bookings

The person making a group booking is responsible for:

  • providing accurate booking details;
  • ensuring payments are made when required;
  • communicating important event information to the group; and
  • making group members aware of these Terms & Conditions.

Large group requests may be subject to additional arrangements agreed directly with us.

13. Behaviour and Conduct

We want everyone to enjoy the event safely.

Guests must behave responsibly and follow reasonable instructions given by:

  • boat crew;
  • event staff;
  • security;
  • venue staff; and
  • the captain.

We may refuse boarding or remove a guest from the event where their behaviour presents a risk to themselves, other guests, staff, the vessel or property.

This may include:

  • aggressive or abusive behaviour;
  • harassment;
  • dangerous behaviour;
  • excessive intoxication;
  • damage to property;
  • interference with safety equipment;
  • failure to follow crew instructions; or
  • possession or use of illegal substances.

Where a guest is refused entry or removed because of their own conduct, they will not normally be entitled to a refund.

14. Alcohol

Alcohol may be available as part of certain ticket packages.

Guests must drink responsibly.

Staff may refuse or stop serving alcohol where they reasonably believe it is necessary for safety, welfare or legal compliance.

An “open bar” or “unlimited drinks” offer does not create a right to unlimited alcohol regardless of a guest's condition.

Service may be restricted where necessary to protect guests, crew and the safe operation of the event.

15. Swimming

Guests may only enter the water when the crew has confirmed that swimming is permitted.

Guests must:

  • follow crew instructions;
  • use any required safety equipment;
  • remain within designated areas; and
  • return to the boat when instructed.

Swimming may be restricted or cancelled because of weather, sea conditions, operational requirements or safety concerns.

Guests should not enter the water if they are unable to swim safely or if alcohol consumption or another factor makes doing so unsafe.

16. Health and Safety

Guests participate in the event at their own risk subject to rights that cannot legally be excluded.

You should consider whether the event is suitable for you before booking.

Please contact us before the event if you have a mobility requirement or another circumstance that could affect boarding, movement around the vessel or participation in activities.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

17. Personal Belongings

You are responsible for your own belongings during the event.

We recommend taking particular care with:

  • mobile phones;
  • cameras;
  • jewellery;
  • money;
  • identification;
  • bags; and
  • other valuables.

Water, movement of the vessel and crowded party conditions create an increased risk of items being lost or damaged.

To the extent permitted by law, we are not responsible for personal belongings that are lost, stolen or damaged unless this results from circumstances for which we are legally responsible.

18. Photography and Video

Photography and video recording may take place during the event.

Content may be used for legitimate event, website, social media or promotional purposes where permitted under applicable law.

Information about how personal data, photographs and video are handled is provided in our Privacy Policy.

If you have concerns about appearing in promotional material, please contact a member of staff or contact us using the details on our website.

19. Customer Photography

Guests are welcome to take personal photographs and videos during the event, provided this does not interfere with:

  • safety;
  • other guests;
  • crew operations; or
  • the enjoyment of the event.

Commercial photography, organised filming or professional production activity may require prior permission.

20. Third-Party Services and Benefits

Some bookings may include or advertise benefits provided by third parties.

These may include:

  • nightclub entry;
  • beach club discounts;
  • cocktails;
  • discount cards;
  • transfers; or
  • other offers.

Third-party services are subject to the third party's own availability, policies and conditions.

Unless legally responsible for the third-party service, we cannot guarantee that a third-party venue or business will provide access where its own admission requirements have not been met.

21. Website Information

We take reasonable care to keep information on our website accurate.

However, event details such as:

  • prices;
  • schedules;
  • ticket inclusions;
  • venue partnerships;
  • departure times; and
  • promotions

may change.

The information shown during checkout and in your final booking confirmation should be treated as the specific details applicable to your booking.

Obvious pricing or technical errors do not automatically create a right to purchase a service at an incorrect price.

22. Payments

Payments may be processed by a third-party payment provider.

Payment information is handled in accordance with the payment provider's security and privacy practices.

A booking may be cancelled or suspended where:

  • payment fails;
  • payment is reversed;
  • fraudulent activity is suspected; or
  • the transaction cannot be verified.

23. Force Majeure and Events Outside Our Control

We are not responsible for failure or delay caused by events outside our reasonable control.

These may include, where applicable:

  • severe weather;
  • unsafe sea conditions;
  • harbour closures;
  • emergency maritime restrictions;
  • government action;
  • strikes;
  • infrastructure failure;
  • serious accidents;
  • natural disasters; or
  • other unavoidable and extraordinary circumstances.

Where such circumstances affect an event, we will take reasonable steps to communicate with affected customers and provide any remedies required under applicable law.

24. Liability

Nothing in these Terms excludes or restricts any liability or consumer right that cannot lawfully be excluded or restricted.

Subject to applicable law, we are not responsible for losses that:

  • were not reasonably foreseeable;
  • arise from a guest's own actions;
  • arise from failure to follow safety instructions;
  • arise from circumstances outside our reasonable control; or
  • relate to business or commercial losses where the booking was made as a consumer.

These Terms do not exclude liability for death or personal injury where liability cannot legally be excluded.

25. Complaints

If something goes wrong during the event, please raise the issue with a member of staff as soon as possible so that we have an opportunity to resolve it.

Please include:

  • booking reference;
  • event date;
  • name of the lead booker; and
  • details of the issue.

26. Privacy

We process personal information in accordance with our Privacy Policy and Cookie Policy. These policies explain how personal information is collected, used, stored and shared.

27. Changes to These Terms

We may update these Terms & Conditions where necessary because of:

  • changes to our services;
  • operational requirements;
  • supplier arrangements; or
  • changes in law.

The version that applies to your booking will generally be the version in force when the booking was made, except where a later change is required by law.

28. Governing Law

These Terms are governed by the laws of Spain, subject to any mandatory consumer protections that apply to you.

Nothing in these Terms removes any right you may have to bring a claim before a court or authority where applicable consumer law gives you that right.
